These Layaway Terms and Conditions apply to layaway transactions at participating CITITRENDS stores. By starting a layaway, the customer agrees to these terms, the transaction-specific terms shown on the layaway receipt or ticket, and any applicable state-law modifications. If any term conflicts with applicable federal, state, or local law, applicable law controls.
1. Participation and INSIDER’S CLUB Membership
Layaway is available only as a free benefit to enrolled CITITRENDS INSIDER’S CLUB members. INSIDER’S CLUB membership is free and available at checkout or by completing the enrollment process at https://sc.cititrends.com/. CITITRENDS may require INSIDER’S CLUB account information, valid identification, the original receipt, or other reasonable verification for layaway payments, pickups, cancellations, refunds, or merchandise credits.
Promotional text message and email marketing are optional and are not required to join INSIDER’S CLUB, use layaway, or make a purchase. Consent to marketing communications is separate from layaway eligibility.
2. Eligible and Excluded Merchandise
Most merchandise physically available for sale in participating stores may be placed on layaway, subject to inventory availability, system eligibility, and these terms. Clearance merchandise, final sale merchandise, gift cards, previously purchased merchandise, online-only merchandise, merchandise not available in the store at the time the layaway is opened, and any other merchandise designated by CITITRENDS as ineligible may not be placed on layaway.
3. Opening a Layaway
A minimum layaway purchase of $20.00 is required. A $2.00 setup fee applies to each layaway, except where prohibited or modified by applicable law. A minimum down payment of 20% of the layaway total is required when the layaway is opened. The receipt or layaway ticket will show the merchandise placed on layaway, total purchase amount, fees, taxes, amount paid, remaining balance, payment due dates, final due date, and other transaction-specific information.
4. Layaway Period and Payment Schedule
Layaway must be paid in full within 60 days from the date it is opened. A payment is required at least every 14 days. Customers may pay the balance earlier at any time during the layaway period. Merchandise will not be released until the layaway balance is paid in full.
5. Merchandise Hold and Pickup
CITITRENDS will hold eligible merchandise placed on layaway during the layaway period, subject to these terms. Pickup must be completed at the store where the layaway was opened unless CITITRENDS authorizes another pickup location. CITITRENDS may require the original receipt, INSIDER’S CLUB account information, valid identification, or other reasonable verification before releasing merchandise.
6. No Partial Pickups, Substitutions, or Exchanges
Partial pickups, partial take-outs, partial cancellations, substitutions, and exchanges are not permitted while merchandise is in layaway. A customer who wants to change merchandise may be required to cancel the layaway and begin a new transaction, subject to these terms and applicable law.
7. Price Adjustments and Promotions
Merchandise placed on layaway will not be marked down while in layaway. Price adjustments, coupons, promotions, and markdowns after the layaway is opened do not apply to merchandise already placed on layaway unless required by law or expressly permitted by CITITRENDS policy. Clearance and final sale merchandise are not eligible for layaway.
8. Cancellation by Customer
A customer may request cancellation of a layaway before final payment. If a layaway is cancelled, the merchandise will be returned to stock, and amounts paid may be provided as merchandise credit less the $2.00 setup fee and a $10.00 return-to-stock fee, except where prohibited or modified by applicable law.
9. Missed Payments, Expiration, and Return to Stock
CITITRENDS may cancel a layaway and return merchandise to stock if required payments are not made, if a payment is not made at least every 14 days, if the final balance is not paid within 60 days, or if other layaway terms are not met. If a layaway is cancelled or returned to stock, eligible amounts paid may be provided as merchandise credit less applicable fees, except where prohibited or modified by applicable law.
10. Refunds, Merchandise Credit, and Fees
Unless applicable law requires a different refund treatment, refunds for cancelled, expired, delinquent, or returned-to-stock layaways may be issued in the form of merchandise credit. The $2.00 setup fee and $10.00 return-to-stock fee may be deducted from amounts paid, except where prohibited or modified by applicable law. Fees may be subject to tax where applicable.
11. Merchandise Unavailable or Damaged
If merchandise becomes unavailable in the same condition before the end of the layaway period for reasons outside the customer’s control, CITITRENDS will provide a refund or merchandise credit as required by company policy and applicable law.
12. Transactional Communications
CITITRENDS may use the customer’s phone number, email address, mailing address, INSIDER’S CLUB account information, or other contact information to provide transaction-related layaway communications, including payment reminders, expiration notices, pickup information, refund or merchandise credit information, and account administration notices. Transactional communications are not promotional marketing messages.
13. Privacy and Marketing Choices
CITITRENDS may collect and use personal information needed to create or locate an INSIDER’S CLUB account, administer the layaway transaction, track payments, provide transaction-related notices, process payments and refunds or merchandise credits, maintain records, and help prevent fraud. CITITRENDS handles personal information as described in its Privacy Policy.
Promotional email and marketing text message consent are optional. Customers do not have to agree to promotional emails or marketing text messages to join INSIDER’S CLUB, use layaway, or make a purchase. Customers may opt out of marketing communications as described in the applicable message, INSIDER’S CLUB terms, or Privacy Policy.
14. No Credit or Financing
Layaway is not a credit sale, loan, financing arrangement, or buy-now-pay-later product. No interest is charged by CITITRENDS on the layaway balance. Merchandise is not released until the layaway balance is paid in full.
15. Receipt, Notice, and Customer Acknowledgment
The posted layaway notice, customer receipt, layaway ticket, and online terms together describe the layaway transaction. By starting a layaway, the customer acknowledges receipt of the posted layaway notice before payment, agrees to the applicable Layaway Terms and Conditions, and understands the setup fee, down payment, payment deadlines, cancellation terms, refund or merchandise credit terms, and full terms available online by URL or QR code.
16. Program Changes and State-Law Modifications
CITITRENDS may modify, suspend, or discontinue the layaway program prospectively at any time, subject to applicable law. These terms apply except where prohibited or modified by applicable federal, state, or local law. If any term is invalid or unenforceable, the remaining terms will continue to apply to the fullest extent permitted by law.
